Kate  Middleton is more of a trendsetter than she knows.

The poised Duchess of Cambridge, who recently won an injunction against a  French magazine for running topless photos of her, is setting a precedent for  other public figures to stand up against paparazzo.

And Heidi  Klum is apparently one of the trend’s earliest adapters.

The “Project Runway” host, who recently admitted to dating her longtime  bodyguard, is reportedly considering filing a lawsuit after topless photos of  her on vacation have surfaced online.

In the shots, Klum, 39, is seen vacationing with her new  boyfriend, bodyguard Martin Kirsten, with her bikini top off, according to TMZ.

At present, sources close to the former Victoria’s Secret model tell TMZ,  Klum’s camp is trying to locate the original French publication that ran the  photos, since multiple websites have already picked up the photos.

According to the sources, Klum is upset because the photos were a blatant  invasion of privacy, not  unlike Middleton’s case, in which she was snapped in a “healthy and  profoundly intimate” moment at a villa in southern France, as Middleton’s lawyer  Aurelien Hamelle argued.

Klum was on a private beach at the time the photos were taken, the sources  tell TMZ.

And though the mother of four would like to take legal action immediately,  her next plan of action is to instead wait and see what happens with Middleton’s  case, TMZ reports.

As of earlier this week, France’s Closer magazine was prohibited from  publishing any more of the Middleton photos either in print or online, and any  violations will result in fines of $13,000 for every day that they’re available,  or $130,000 if the publication decides to sell them, according to Sky News.

Middleton and Prince William are also filing a criminal complaint against  the photographer, who has not yet been named.
