The actor, best known for playing Xander Harris in Buffy the Vampire Slayer, was reportedly picked up by police after a domestic dispute in New York City on Wednesday.
The 44-year-old now faces charges of robbery, obstruction of breathing and criminal mischief, according to Saratoga Springs police Lt. Bob Jillson.
Nicholas played the much-loved student Xander between 1997 and 2003, but more recently starred as Kevin Lynch in Criminal Minds.
His girlfriend is said to have told police officers who were called to a downtown hotel, that she had gone to return property to the TV star when the incident occurred.
But Nicholas objected, grabbed her car keys and then threw her phone into the street when she tried to call for help, a police report revealed.
“It sounds like it went downhill from there,” Bob informed AP. “He allegedly grabbed her by the throat and started choking her.”
The star, who has been arrested multiple times over the past year, was gone when officers arrived but he was arrested a short while later. He was believed to be intoxicated.
Nicholas was released from jail the following day after posting a $20,000 bond
Last October, he apologised after being arrested on charges of resisting officers and malicious injury to property after a confrontation in Idaho.
And in May, he was charged with public intoxication while in South Carolina, for the XCon World Comic Convention.
